The Social Security Administration provides monthly payments ("SSI") to people with disabilities
without much outside income. SSI recipients usually qualify for food stamps and Medicaid, and
sometimes, they can also qualify for Medicare coverage.
To obtain these benefits, you must apply. To meet the Social Security Administration
application definition of "disabled," you must have an impairment that keeps you from working,
and from earning above a certain amount, for at least twelve consecutive months.
This application process is difficult. It takes a long time. There is a very real chance that the
initial application will be denied. This makes your SSI appeal very important.
There are four kinds of appeal, beginning with reconsideration and continuing on through
administrative law hearing; appellate council review; and federal court review. Each level is a
new bite at the apple; benefits can be granted at any of these four appellate reviews.
It can take years to go through the appeals process. The government has no deadline. The
agency is also overworked, with not enough workers and ever-increasing numbers of
applications being filed.
