Birth Injuries
Atlanta, Georgia Personal Injury Lawyer
It is not uncommon for babies to be injured as they are being born; this happens a lot more than
people think. In most cases, the injuries are not serious and resolve themselves within the
infant's first few days of life. However, there are times when those injuries are more serious
and their impact, more long-term.
During a vaginal delivery, the baby's head undergoes a great amount of pressure. The infant
can suffer bruising to his face, head, and neck. The baby's head can be swollen. The baby's
eyes may have broken blood vessels; the baby's face may even be temporarily paralyzed. All
these frightening symptoms of a difficult birth usually resolve themselves: babies are very
resilient.
However, there are times when a baby suffers from Erb's Palsy - here, the baby's shoulders
have been a problem during delivery and the baby has suffered a broken collarbone or clavicle.
Even more serious are instances when the baby's brain does not get enough oxygen during the
birth, and as a result, she suffers from permanent disabilities, like cerebral palsy.
If you or a loved one has a child who has suffered from a serious birth injury, then there may be
legal remedies available to address such areas as medical expenses, pain and suffering, and
long-term care needs. A number of parties may be partially responsible: HMOs, nurses,
doctors, pharmacists, and other medical professionals the responsibility for a birth injury may
lie with more than one health care provider.
